Digital Wallet Terms of Use

(Apple Pay, Samsung Pay, Google Wallet, LG Pay, Fitbit/Garmin Pay)

Digital Wallets, i.e. Apple Pay, Samsung Pay, Google Wallet, LG Pay, Fitbit/Garmin Pay, (“Wallet Provider”), allows you to attach your SAFE Federal Credit Union (“Credit Union”) issued Visa ® debit and/or credit card (“Payment Card”) to a digital storage system (“Digital Wallet”), providing additional electronic payment options.  This Digital Wallet Terms of Use governs your use of any eligible debit card or credit card issued by the Credit Union when you add, attempt to add or keep a Payment Card in a digital wallet or any other electronic payment system into which your Payment Card may be enrolled by you on any mobile phone, tablet, watch or other device which supports a Digital Wallet.  In these Terms, “you” and “your” refer to any person that seeks to add a Payment Card to any Digital Wallet, and “we,” “us,” “our” and “Credit Union” refer to the issuer of your Payment Card. Please save a copy of this information for your records.

Your Payment Card is governed by the Membership, Account and Account Services Agreement (“Membership Agreement”), the Electronic Fund Transfer Agreement and Disclosures (“EFT Agreement”) and when applicable, Visa Platinum Rewards, Low-Rate or Classic Credit Card Disclosure (“Credit Card Disclosure”).  These agreements may describe the applicable fees, interest and other rights and obligations that apply when you use a Payment Card.  You also understand that your use of the Digital Wallet will be subject to agreements or terms of use with the applicable Wallet Provider or other third parties, such as wireless companies or data service providers. 

GOVERNING LAW/ VENUE/ JURISDICTION
 

This Digital Wallet Terms of Use shall be construed in accordance with and governed by the laws of the State of South Carolina. This Digital Wallet Terms of Use is performable in Sumter County, South Carolina, and venue shall be proper in such county for all purposes. You consent to jurisdiction with regard to any claim or proceeding related to this Digital Wallet Terms of Use in any state or federal court in the State of South Carolina. 

 

If you do not agree to these Digital Wallet Terms of Use, do not create, activate or use a Payment Card.

USING A PAYMENT CARD IN THE DIGITAL WALLET

 

When you elect to add a Payment Card to the Digital Wallet on your device, you must follow the procedures adopted by the Wallet Provider and any other necessary procedures the Credit Union adopts.  It is possible that not all Payment Cards will be eligible to be added to the Digital Wallet.  If the Credit Union cannot authenticate the Payment Card or there is suspicion that fraud may be associated with the Payment Card, the Credit Union may not add the card to the Digital Wallet.  The Digital Wallet allows you to make purchases with the Payment Card wherever the Digital Wallet is accepted.  The Digital Wallet may not be accepted outside the United States or at all places other payment types are accepted. 

APPLICABLE FEES
 

The Credit Union does not charge you any fees for adding a Payment Card to the Digital Wallet. Please consult your Membership Agreement, Credit Card Disclosure and the Fee Schedule for any applicable fees, interest or other charges associated with your Payment Card. In addition, the Wallet Provider or other third parties, such as wireless companies or data service providers, may charge you service fees in connection with your use of your Device or the Digital Wallet.

 

USE OR FUNCTION OF THE DIGITAL WALLET

 

The Credit Union is not the provider of the Digital Wallet, and we are not responsible for providing the Digital Wallet service to you. We are only responsible for supplying information securely to the Wallet Provider to allow usage of the Payment Card in the Digital Wallet. We are not responsible for any failure of the Digital Wallet for any transaction. We are not responsible for the performance or non-performance of the Digital Wallet or any other third parties regarding any agreement you enter into with the Wallet Provider or associated third-party relationships that may impact your use of the Digital Wallet. You acknowledge that you have read and accepted the terms and conditions of the Digital Wallet by requesting that your Payment Card be added to the Digital Wallet.

SECURITY
 

Storing account numbers, passwords or codes on any device, using any account numbers, passwords or codes in any verbal communications, or using any device in a public place such as an airport, hotel, concert or sports facility may result in interception and misuse of that information by a third party. We cannot prevent interception by third parties of any communications made by the device. We have no responsibility for any losses resulting from information that a third party may obtain by intercepting communications made through the device or by accessing data that you may store on the device.

 

You are responsible for maintaining the confidentiality of your Credit Union user identification (“ID”), Apple User ID, Apple passwords and other means you may from time to time have to access for any of your Payment Cards. You should keep your supported device and these credentials secure in the same manner as you would keep your cash, checks, credit cards and debit cards and other personal identification numbers and passwords secure. Subject to the Membership Agreement, EFT Agreement, and/or Credit Card Disclosure, you are responsible for all transactions made using your Payment Card.

 

Since your mobile device can be used like a Payment Card to make purchases, you must notify the Credit Union in the event your mobile device is lost or stolen with the same urgency as if your actual Payment Card is lost or stolen. If you fail to notify the Credit Union, you may be liable for all or a portion of the losses associated with unauthorized use of your Payment Card, whether or not that use was through the Digital Wallet service. If you get a new device, you must delete all your Payment Card(s) and other personal information from your prior device.

 

You must also cooperate with the Credit Union in any investigation and use any fraud prevention or other related measures the Credit Union sets.

You are solely responsible for maintaining the confidentiality of your user IDs, passwords and any other means that you may from time to time have to access the application. If you share these credentials with any other person, they may be able to use your Payment Card and get access to your personal and payment information available through these and related services. Sharing of your credentials with another person will create an authorized user until such time as you provide us notice in writing and we have time to act upon such notice. Call us immediately at the Credit Union telephone number printed below if you believe your device or authentication credentials have been lost, stolen or compromised in any way or an unauthorized person has used or may use your credentials without authorization.

We make no representations or warranties as to merchantability, or that the security devices are fit for a particular purpose or are sufficient to protect you against unauthorized access to your accounts or computer systems. You acknowledge that the security devices may not be the most sophisticated or advanced devices available and that we have no obligation except to offer reasonable security devices to you.  You should obtain independent advice on the security of your computer systems and whether the security devices provide sufficient protection to you and your accounts and computer systems.

BLOCKING, SUSPENDING OR CANCELLING A PAYMENT CARD

The Credit Union reserves the right to block you from adding an otherwise eligible Payment Card to the Digital Wallet, suspend your ability to use a Payment Card to make purchases using the Digital Wallet or cancel entirely your ability to continue to use a Payment Card in the Digital Wallet. We may take these actions at any time and for any reason, such as if we suspect fraud with your Payment Card, if you have an overdue or negative balance on your Payment Card account, if applicable laws change or if directed to do so by the Wallet Provider or the applicable card network (such as Visa). You may remove a Payment Card from the Digital Wallet by following the Wallet Provider’s procedures for removal.

ELECTRONIC CONTACT AND EMAIL

 

You consent to receive electronic communications and disclosures from us in connection with your Payment Card and the Mobile Wallet. You agree that we can contact you by email at any email address you provide to us in connection with any Credit Union account. It may include contact from companies working on our behalf to service your account(s).  You agree to update your contact information with us when it changes. By accepting the terms and conditions of this Digital Wallet Terms of Use, you agree that it is subject to the Federal Electronic Signature in Global and National Commerce Act (“E-Sign Act”). Continued use of a Payment Card in a Digital Wallet requires that you agree to receive all notices and disclosures electronically. If you prefer to receive paper notices and disclosures, you have the right to withdraw your consent, in which case we may terminate your use of the Payment Card in a Digital Wallet.

CHANGE IN TERMS

 

The Credit Union may change these Digital Wallet Terms of Use at any time, by changing these Terms, the Membership Agreement, Credit Card Disclosure or EFT Agreement and we will provide advance notice of these changes if we are required to do so under applicable laws. You agree to any such changes by continuing to keep a Payment Card in the Digital Wallet. The date of the most recent change to these Terms is shown at the bottom of these Terms. If you do not accept a change to these Terms, you must remove all Payment Cards from all Digital Wallets.

 

TERMINATION OF TERMS AND ASSIGNEMENTS

 

We can terminate or assign these Digital Wallet Terms of Use at any time.  We can also change these Digital Wallet Terms of Use, or add or delete any terms or conditions, at any time. We will provide notice if required by law. You cannot change these Digital Wallet Terms of Use, but you can terminate these them at any time by removing all Payment Cards from the Digital Wallet.  You may not assign these Digital Wallet Terms of Use.

OUR COMMITMENT TO YOUR PRIVACY
 

Your privacy and the security of your information are important to us. The Credit Union Privacy Notice applies to the use of your Payment Card in the Digital Wallet.  The Privacy Notice is available online at www.safefed.org.  You agree that we may share your information with the Wallet Provider, a payment network and others in order to provide the services you have requested, to make information available to you about your Payment Card transactions and to improve our ability to offer these services. This information helps us to add your Payment Card to the Digital Wallet and to maintain the Digital Wallet. We do not control the privacy and security of your information that may be held by the Wallet Provider, and that is governed by the privacy policy given to you by the Wallet Provider.
